1. Agreement to Terms

By accessing or using My Whisper, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the service.

2. Description of Service

My Whisper is a voice dictation application that:

  • Records audio from your device
  • Transcribes audio to text using AI
  • Stores your recordings and transcriptions
  • Learns from your corrections to improve accuracy
  • Allows sharing recordings with others

3. User Accounts

Anonymous Use

You may use My Whisper without creating an account, with limited functionality (2 recordings). Anonymous recordings are tied to your browser and cannot be recovered if you clear your browser data.

Google Sign-In

For full access, you can sign in with Google. By signing in, you agree to:

  • Provide accurate account information
  • Maintain the security of your Google account
  • Accept responsibility for all activity under your account

4. User Content

Ownership

You retain ownership of all audio recordings and transcriptions you create. By using My Whisper, you grant us a limited licence to:

  • Store and process your content to provide the service
  • Create transcriptions of your recordings
  • Apply personalisation based on your corrections

Shared Content

When you share a recording, anyone with the link can view the audio and transcription. You are responsible for ensuring you have the right to share any content.

5. Acceptable Use

You agree not to use My Whisper to:

  • Record conversations without consent where required by law
  • Upload content that infringes intellectual property rights
  • Upload illegal, harmful, or offensive content
  • Attempt to bypass usage limits or access controls
  • Interfere with the service's operation or security
  • Use automated systems to access the service without permission

6. Intellectual Property

My Whisper, including its design, code, and branding, is owned by Abiola Fatunla. You may not:

  • Copy or modify the service's code without permission
  • Use our branding or trademarks without authorisation
  • Reverse engineer any part of the service

7. Third-Party Services

My Whisper relies on third-party services including:

  • OpenAI for transcription
  • Supabase for authentication and database
  • Amazon Web Services for storage
  • Vercel for hosting

These services have their own terms which may affect your use of My Whisper. We are not responsible for third-party service availability or changes.

8. AI-Generated Content

Transcriptions are generated by artificial intelligence and may contain errors. You acknowledge that:

  • AI transcriptions are not guaranteed to be accurate
  • You should review transcriptions before relying on them
  • We are not liable for errors in AI-generated content
  • AI outputs should not be used as the sole basis for important decisions

9. Service Availability

We strive to maintain service availability but do not guarantee uninterrupted access. We may:

  • Modify or discontinue features without notice
  • Perform maintenance that temporarily affects availability
  • Suspend accounts that violate these terms

10. Disclaimers

My Whisper is provided "as is" without warranties of any kind, either express or implied, including but not limited to:

  • Fitness for a particular purpose
  • Merchantability
  • Non-infringement
  • Accuracy or reliability of transcriptions

11. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for:

  • Indirect, incidental, special, or consequential damages
  • Loss of data, profits, or business opportunities
  • Damages resulting from your use or inability to use the service
  • Errors or inaccuracies in transcriptions

Our total liability shall not exceed the amount you paid us in the twelve months preceding the claim, or £50, whichever is greater.

12. Indemnification

You agree to indemnify and hold harmless My Whisper and its operator from any claims, damages, or expenses arising from:

  • Your use of the service
  • Your violation of these terms
  • Your violation of any third-party rights
  • Content you upload or share

13. Termination

You may stop using My Whisper at any time. We may terminate or suspend your access:

  • For violating these terms
  • If required by law
  • If we discontinue the service

Upon termination, your right to use the service ceases immediately. We may delete your data after a reasonable period following termination.

14. Governing Law

These terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

15. Changes to Terms

We may modify these terms at any time. Continued use of My Whisper after changes constitutes acceptance of the new terms. We will update the "Last updated" date when changes are made.
